Terms of Service

Welcome to FireMode. These Terms of Service ("Terms") are a legal agreement between you and FireMode ("FireMode," "we," "us," or "our") governing your use of the FireMode mobile app and the website at firemode.app (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Eligibility

You must be at least 16 years old to use the Service. By using FireMode you represent that you meet this requirement and that the information you provide is accurate.

2. What FireMode is

FireMode is a social competition app. You create or join time-limited "battles" with friends, log your food, drinks, or activity (including by photo), and compete on a live leaderboard. Scores are calculated automatically, including by AI analysis of the photos you submit.

Not a gambling or betting service. FireMode is for friendly competition and bragging rights. The Service does not host, facilitate, or process real-money wagering, prize pools, or payouts. Any side agreement between friends is solely between those individuals and is not part of, or endorsed by, the Service.

3. Your account

You're responsible for activity on your account and for keeping your sign-in method secure. You may delete your account at any time from within the app.

4. Your content

You retain ownership of the photos and content you submit ("Your Content"). You grant FireMode a non-exclusive, worldwide, royalty-free license to host, process, display, and use Your Content as needed to operate and improve the Service (for example, analyzing a photo to score a battle and showing your results to other players in that battle). You represent that you have the rights to the content you submit.

5. Acceptable use

You agree not to:

Submit false, manipulated, or misleading photos or data to gain an unfair advantage;
Harass, threaten, or abuse other users, including in group chat;
Post unlawful, infringing, or harmful content;
Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.

We may suspend or terminate accounts that violate these Terms.

6. Health disclaimer

FireMode is for entertainment and motivation only and is not medical, nutritional, or fitness advice. AI-generated calorie, nutrition, and activity estimates may be inaccurate and should not be relied on for medical or dietary decisions. Consult a qualified professional before making changes to your diet, exercise, or health routine. Use the Service at your own risk.

7. Alcohol

Some battles involve logging beverages, including alcoholic ones, and are framed around moderation (for example, "fewest drinks"). You must be of legal drinking age in your jurisdiction to log alcoholic beverages. FireMode does not sell, supply, or encourage the consumption of alcohol. Please drink responsibly.

8. Third-party services

The Service relies on third parties (such as Apple, Amazon Web Services, and Google AI). Your use of features that depend on them may also be subject to their terms. We are not responsible for third-party services.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that scoring will be accurate.

10. Limitation of liability

To the maximum extent permitted by law, FireMode and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the past 12 months or US $50.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users.

12. Changes to these Terms

We may update these Terms from time to time. We'll revise the "Last updated" date and, where appropriate, notify you in the app. Continued use after changes means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located there for any dispute not subject to arbitration or small-claims court.
